    RESUMO: 
    The selection of the seat of an EU agency has always been a sensitive procedure with national interests at stake. The political sensitivity even threatened the EU unity during the negotiations on the UK withdrawal fiorn the EU.The nature of this process entails intensive competition among the individual offers as witnessed in recent selections of the new seats. The results of the selection have been diverse, with some of the agencies having their seats embedded in the EU legal acts, whilst others are solely in the Decisions of the Representatives of the Governments of the Member States.a According to the Member States, the latter decisions were based on Article 341 TFEL. This provision stipulates the following: The seat of the institutions of the Union shall be determined by common accord of the governments of the Member States.’ The European Parliament was criticiz ing the intergovernmental decision-making based on this provision claiming that it should be fully involved as co-legislator. It was obvious that the dispute would sooner or later necessitate a judicial resolution. [Da introd.]
