The present paper looks at the undercover agent, mainly in relation to his report and to the trial hearing; it argues that, in Portugal as well as in Brazil, both means are subject to the rule of law, and as such, they have to comply with a body of legal rules in order to be accepted and evaluated by the judge. Yet, we establish that, even under some level of sacrifice of fundamental rights, the use of this method of gathering evidence is legitimate and efficient to face organized, transnational and hideous crimes, including terrorism, all according to constitutional cornerstone principles, namely human dignity and also adversary proceedings, full defence and proporcionality in a delicate balance among the rights of liberty, public welfare and criminal justice efficiency.
